Privacy Policy

This Data Protection Information aims to inform you, in addition to our general data protection declaration, about processing your personal data when using this mobile application (App).

FEIG ELECTRONIC GmbH, Industriestrasse 1a, D-35781 Weilburg, info@feig.de, is responsible for processing your personal data with the respective gate manufacturer on whose behalf or according to whose instructions you operate and/or maintain the respective gate using this App.

We have entered into a joint responsibility agreement with the respective gate manufacturer in accordance with Article 26 GDPR. In this contract, we have agreed how we jointly decide on the means and purposes of processing your personal data and who is responsible for which data processing. We have also stipulated that FEIG ELECTRONIC GmbH is responsible for informing you about the data processing and is available to you as a contact for your data subject rights, without this limiting your rights in respect of the controller who is jointly responsible with us.

However, we are solely responsible for the processing of your personal data insofar as you operate and/or maintain the respective gate on behalf of or according to the instructions of FEIG ELECTRONIC GmbH by means of this App or the respective gate manufacturer on whose behalf or according to whose instructions you operate and/or maintain the respective gate doesn’t have access to the FEIG licence server.

Scope of the Data Processing

If you download the App from the respective App store, the following data will automatically be transferred to the respective App store: your user name, e-mail address, your customer number at the respective App store and the individual device identification of your device. Neither we nor the person jointly responsible with us have any influence on this data processing. The operator of the respective App store is solely responsible for this.

If the App is on your device, you must first register to be able to use all functions of the App. During registration, you must enter your name, your e-mail address, the name of your company or employer, the name of the gate manufacturer whose gate you operate and/or maintain, a user ID of your choice, a password of your choice and, if necessary, a TAN transmitted by the respective gate manufacturer. The data you provide - with the exception of the password - will be stored on the FEIG licence server. We or the person jointly responsible with us shall add your user role (if not already predefined by the TAN) and the expiry date of your user licence to your data record. The expiry date of the licence is displayed to you within the App and is automatically checked by the FEIG licence server each time the App is restarted, whereby these licence check requests are logged on the licence server in pseudonymised form.

 

Our App also uses the Bluetooth interface of your device to establish a connection to the gate that you operate and/or maintain using this App. To activate the interface, you may have to accept a request for your location. However, our App does not use the location information. In addition, our App temporarily accesses the file system of your device during the export and import of parameter files.

Within the scope of using the App, remote maintenance for support purposes can be performed at your request. The support employee will only have access to the data processed in the App. Reports on any error messages and/or crashes of the App are forwarded to us without access to personal data.

We process this data on the basis of Article 6 (1), Point b) GDPR, for the purpose of establishing, implementing and terminating the usage contract concluded with you concerning our App. The purpose of the data processing is to enable the use of the App for easier gate operation and maintenance. In addition, the data processing serves to prevent unauthorised gate operation and maintenance. If you do not provide us with the requested personal data, registration for the App cannot take place, and a contract of use concerning the App will not be entered into.

Only we and the gate manufacturer have access to your data as part of the joint responsibility. Your data shall not be forwarded to third parties.

Your data are stored on a FEIG (licence) server located in Germany. In the case, that your data are transferred to a third country, we ensure, that the special requirements of Article 44 et seq. GDPR are met. If an adequacy decision in accordance with Article 45 GDPR exists for the third country, we rely on this. Otherwise, we generally use EU standard contractual clauses in accordance with Article 46 (2) Point c) GDPR. Automated decision-making including profiling does not take place.

We generally store your data for the duration of the user contract. However, you can arrange for the erasure of your data yourself within the App or by means of an e-mail. Furthermore, the gate manufacturer can arrange for your data to be erased if, for example, your field of activity changes or your employment relationship ends on the basis of which you operate and/or maintain the respective gate using this App. Your data will also be automatically erased if you have been inactive for 6 months or your licence has expired. In these cases, you will receive an email one month before your data are deleted with a notice of the impending deletion.

Beyond this, we only store your data if we are obliged to store it for a longer period due to legal requirements. The further storage is then based on a legal obligation, so that the data processing then finds its legal basis in Article 6 (1) Point c) GDPR.


Your Rights

You have the following data subject rights with regard to your personal data:

 

-      Right of access (Article 15 GDPR),

-      Right to rectification (Article 16 GDPR),

-      Right to erasure (Article 17 GDPR),

-      Right to restriction of processing (Article18 GDPR),

-      Right to data portability (Article 20 GDPR),

-      Right to object to the processing (Article 21 GDPR).

 

In accordance with Article 77 GDPR, you may also lodge a complaint with a data protection supervisory authority.

If you have given us your consent, you can revoke it at any time without affecting the lawfulness of the data processing performed up until the revocation.
